DUE DILIGENCE EVALUATIONS

Due diligence is defined as “reasonable steps taken by a person/entity in order to satisfy a legal requirement, especially in purchasing or selling something”. DuBois and Associates conducts various due diligence services of real property for clients who are entering into real estate transactions, loan transactions, and mergers. 

Phase I Environmental Site Assessments (ESA) 

DuBois and Associates has conducted many Phase I Environmental Site Assessments in accordance with the ASTM Standard Practice E1527 and in compliance with All Appropriate Inquires (AAI) in order to satisfy the requirements to obtain innocent landowner liability protection under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).

Preliminary Assessments (PA)

DuBois and Associates is experienced in conducting Preliminary Assessments in accordance with the New Jersey Department of Environmental Protection’s (NJDEP’s) Technical Requirements for Site Remediation, N.J.A.C. 7:26E for the purposes of obtaining protection from potential liability under the New Jersey Spill Compensation and Control Act, N.J.S.A. 58:10-23.11 et seq. 

Geophysical Services

DuBois and Associates provides geophysical scanning services to locate subsurface utilities, buried drums and debris, underground storage tanks (USTs), dump areas, septic systems, wells, foundations and other subsurface features. Geophysical investigations are typically conducted to confirm the presence/absence of previously unknown/undocumented USTs, buried drums or debris on a particular property, and can also be used to clear locations for subsurface drilling activities to prevent potential damage to subsurface utilities (i.e. electric, gas, water, sewer, telecommunications). The Ground Penetrating Radar (GPR) and magnetic systems used deliver instant real time data, which is displayed on a computer in the field. Data in the field is linked to satellite global positions systems (GPS) for accuracy, and can be electronically conveyed to the office for further evaluation. The data can be displayed in various graphical displays, which can be easily construed and appraised. 

Phase II Environmental Site Assessments/Site Investigations (SI)

Phase II ESAs/Site Investigations typically commence following the completion of a Phase I ESA and/or Preliminary Assessment to assess the presence or potential presence of environmental impacts at a property. A Phase II ESA/SI may include the performance of soil and/or ground water sampling, subsurface drilling, tank testing, among other activities. DuBois Environmental is proficient in providing Phase II ESA/SI services at competitive rates while considering the client’s project specific needs for the purpose of reaching tailored solutions for a given project.
